In a restorative justice framework achievement and child right in line with law to enjoy his right according to the International rights standards of the child rights & Beijing Rules, Riyada Volunteer Center works in full coordination with family, child and child prosecutor protection units to achieve the restorative justice and referral outside the judiciary system.
Referral outside the Judicial referral system: it a therapeutic community entrance planned with the participation of formal and informal structures with the aim to find trouble shooting of delinquent children who refer to community advice and are considered prosecution and detention alternatives and realized with (referral outside the Judicial System) and disputes settlement.

What Community Advice?

Because the community advice and restorative justice are more effective in term of cost of detention and it reduces the light crimes , less serious, block the justice system, detention centers and allowed the supplies to focus on offenders with repeat and high risks.
As advice is more comprehensive, encourage the victims participation, defender, delinquent ,law officers, local community representative and any other individuals affected by crime who might have participation in procedures.

The community advice requires human and financial sources furthermore, than professionals less profiles in most misinformation mechanism according to the assessment professionals in Juvenile Justice or multidisciplinary team and provisions, for example, oral or written apology to the victim , written article of the cover up or traces of the committed crime, symbolic/non-monetary compensation to the victim ,agreement to school/training attendance on occupational skills, inclusion of child offender in referral /community advice plan in agreement.

The Community Advice

It is operation in which the child offender and , the victim, and individual of its co-sponsors communities to negotiate the damage could they have of offender commitment and how to reconcile these damages and how the child was prevented the recurring delinquency.
Where was the beginning in applying transferring approach outside the judicial system of Riyadah Volunteer Center since 2013 to 2021 and the program is still going on in the state of Khartoum.
Since the beginning had been experienced in many different Sudanese states such as Khartoum , North Darfour, West Darfour, Mid Darfour , South Darfour, Blue Nile and White Nile.

Where Riyadah Volunteer Center at that time, within civil community organizations role framework has applying referral Form outside the Judicial System as children issues advocacy mechanism by training 2466participants in the following subjects:
Referral System outside Judicial System.
Social Psychological support skills
Code of Behavior
For seven days by (72hrs) of training each training chain.

Training Program for Judicial System outside referral approach include the following/authorities

Community protection Committees, Police Teachers, Ministry of Health, Legal, Mayors, sheikhs, Social and psychological researchers, resistance committees, Ministry of Social Development, Organizations acting in childhood care representatives, and public information officers.

First: Coordinate to work and standardization of and procedures between competent judicial bodies
Several coordination workshops have been established to negotiate many issues of referral matter in participation of child prosecutors, Family and child protection units, Juvenile Courts, the child’s national council, some competent organizations, Voluntary protection committees then negotiating and challenges and gaps, and the workshops came up with several recommendations most notably:
1: The importance of coordination between Judicial Bodies orderly, and standardization the work between in referral program outside the Judicial System.
2: Approval of referral, supervising, checking and updating Regulations( Regulations of referral outside Judicial System).
3: A legislative, and regulatory framework must be established to referral as well as to order and organizing the community mechanism and the competent bodies that carry out the referral outside the Judicial System to be part of its Juvenile’s Justice bodies founders.

4: the international, national and regional standards of Juveniles justice (8 standards in regulations) must be accompanied in referral outside Judicial System.
5: To appoint legal assistants affiliated with Juvenile’s Public Prosecution to supervising the referral committees and following up therein.
6: To approve volunteers of referral committees and appointing their supervisor in prosecution and protection units by juvenile’s counsel, Ministry of Work & Social Development in social researchers and social workers.

7: Setting limited for bodies to which the child referred(Institutions, committees, individuals) by which the prosecution guided.
8: Issuance of ID’s by the (competent) Judiciary to legal assistants.
9: The necessity of Civil Community Organizations contribution to the implementation of outside judicial referral system program (outreach programs, training, financial and material support).

10: Existence of Assistants devices to help the referral outside judicial program.
11: To increase the Juveniles Justice Institutions (Juvenile’s Prosecutors, Family and Child Protection Units)
12: Standardization of procedures and setting up standardized Referral Forms agreed to between departments, Prosecutors, and Juvenile’s Courts.

13: Raising community outreach and increasing the awareness doses of referral outside Judicial System.
14: Establishment of Reparation Fund (In Executors & units) for families who are unable to do so.
15: To identify the Judicial supportive bodies (community Committees) to name, identify, and describe its role).

16: Making the standardized operational procedures Directory to accommodate all Judicial Bodies (Police. Prosecutors. Courts) and its supportive devices.
17: Making understanding memorandum between Prosecutor and Bodies referred to (Institutions, civil community, individuals).

To Legalize the community committee for referral in Criminal Development (Mayio as an example) and to coordinate its work with Khartoum protection unit.

Second: Suggestions:
1:Urgent need for such workshop.
2: To intensify the outreach doses in the neighborhoods to revival the common conscience and strengthen the collective responsibility.
3: Marking open day for talents to develop the children capacities.

4: To awareness the Police Departments and individuals by the child Law 2010 and referral outside the Judicial System.
5/; To outreach the Judges and prosecutors and to provide them with children issues and how to deal with them:

The Project strengthen the protection committees effectiveness to engage and cooperate with other active agencies in protection field and the concerned to evaluate and limit prioritization, communicate with, and coordinate the child urgent protection issues. Since the project beginning, Reyiadh Volunteer Center do its best in order to enable the protection committees and concerned. Therefore, many training workshops, library visits, and open negotiation to reach the aim chains had been carried out. These efforts have now it’s clear effects on protection committees and its communities. This can be achieved through several initiations taken by these mechanisms existing on building-confidence and social conscience in different ways such as communications made with relative NGO and actors in child protection scope, as well as sciences and skills developed through workshops have had Significantly affected. According to that, they became confident in themselves in dealing with communities, known people, forums and networks.

To execute the referral program, 1274 children informant in Khartoum and all Darfourian States up to April 30.2021in agreement with three children prosecutors in Omdurman, Khartoum and Khartoum North because of community committees representatives, therefore, the project found trained volunteers of researchers and some other majors in each locality.

Because of many highest intensive children reports, this volunteer team works on case transfer from Prosecutor according to Article 61,.2 of Juvenil Law 2010 , the community advice sessions execute in standards trained to, according to seizure alternatives and referral outside Judicial System (come in details in community committees Directory for referral outside Judicial System of delinquent children, amended by Riyadiah Volunteer Center, P30. Directory enclosed hereto) which explain the procedures before, during and after community advice. Team documented to each cases , community advice outputs and agreement arrived to and the report maintains with to keep the rights of each party by Prosecutors for the need of reference, for the purpose of classification, and study, cases are classified to family which result from disputes within the child family. As for references and knowledge will rising up in school. The cases for which the Prosecution is seeking help from community or transferred by community ( The Community Committees, mayors, Sultans, Sheikhs and Tribal chiefs ) registered and included in Juvenile’s Prosecution statistics and its importance comes for many reasons, First, spacing of distance and the difficulty of reaching the Juvenile’s Prosecution. In addition to these people knowledge of community, their easily ability to supervise the child after community advice to ensure the implementation of agreement.
